1. About these terms
These terms apply to your use of Trucksalot (www.trucksalot.co.uk), which is operated by Direct Commercial Finance Ltd (“we”, “us”). Direct Commercial Finance Ltd is a company registered in England and Wales under company number 07842552, whose registered office is at No.9 Magazine B, Ordnance Yard, Upnor Road, Lower Upnor, Rochester, Kent, ME2 4UY. By using the site you agree to these terms. Please also read our privacy notice.
2. What Trucksalot does
Trucksalot is an online marketplace where dealers and operators advertise trucks for sale and buyers can contact them. We are not the seller of any vehicle, we are not a party to any sale, and we do not hold or handle payments for vehicles. Any contract to buy a truck is between the buyer and the seller.
Adverts are written and supplied by sellers. We review adverts before they go live, but we do not inspect vehicles or verify every detail. Before you buy, check the vehicle, its history, specifications and paperwork with the seller, and consider an independent inspection and vehicle history check.
3. Finance
Finance enquiries are handled by Direct Commercial Finance (DCF), which operates Trucksalot. DCF is a commercial finance broker, not a lender, and is not authorised or regulated by the Financial Conduct Authority. Where DCF cannot arrange finance itself, it may, with your agreement, pass your enquiry to a partner finance broker. Any finance is optional and subject to status and lender approval. Monthly figures shown on adverts are illustrative examples, not quotes or offers of finance.
4. Seller accounts and adverts
If you advertise on Trucksalot, you confirm that:
- you are entitled to sell the vehicle, and the advert is for a vehicle genuinely available for sale;
- the information in your advert is accurate and not misleading, and you will keep it up to date;
- you own, or have permission to use, the photos and text you upload;
- you will comply with the law that applies to you as a seller, including consumer protection law where you sell to consumers; and
- you will keep your login details secure.
You give us a non-exclusive, royalty-free licence to display, resize and publish your advert content on Trucksalot, and to use it to promote your advert, for as long as the advert is on the site.
We may refuse, edit for formatting or accuracy, or remove any advert, and suspend or close an account, if we reasonably believe it breaks these terms or the law. Listing is currently free. We will tell you in advance before introducing any charges, and you will not be charged without agreeing first.
5. Enquiries
When a buyer sends an enquiry about a truck, we pass it to the seller. Finance enquiries are handled by DCF. Sellers are responsible for responding to buyers and for any agreement they make with them.
6. Using the site
You must not misuse the site. This includes posting false, unlawful or offensive content, sending spam, trying to get around our security checks, copying or collecting adverts or data in bulk by automated means without our permission, or interfering with how the site works.
7. Truck News and other content
Articles and guides on Trucksalot are general information only. They are not financial, legal or technical advice. Specifications, prices and availability change, so always confirm details with the manufacturer or supplying dealer.
8. Our responsibility to you
We work to keep Trucksalot available and accurate, but we do not guarantee that it will always be available or free from errors. We are not responsible for the condition, description, legality or sale of any vehicle advertised, or for the acts of buyers or sellers.
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded by law. Subject to that, and to the extent permitted by law, we are not liable for loss arising from your use of the site.
9. Changes to these terms
We may update these terms from time to time. The date at the top shows when they were last changed. If you have a dealer account, we will tell you about significant changes before they take effect.
10. Law and disputes
These terms are governed by the law of England and Wales. Disputes are subject to the courts of England and Wales. If you are a consumer living in Scotland or Northern Ireland, you may also bring proceedings there.
